Terms and conditions for learning analytics web app

By using the learning analytics web app, you agree to these terms and conditions. Please refer to your institution’s privacy policy for information regarding the processing of your personal data.

The learning analytics web app is owned by Jisc and intended to be used with the Jisc learning analytics service.

Purpose of the web app

If you are a student, the main purpose of the web app is to help you understand and monitor your learning and check in to events. If you’re a staff member of an educational institution, the web app allows you to access the learning analytics services that Jisc provides to your institution.

User login

To login to the learning analytics web app, you must enter your institutional email address. You will then be redirected to your institution's sign-in service where you will be authenticated. Upon successful authentication, you will be redirected back to the web app.

Data provided to the web app

Data and analytics relating to you and your learning activities may be provided to Jisc and the web app by your institution.

We store the information that you give us so that you can access the web app. Further information on the collection and use of the data is covered in your institution’s privacy policy. It your institution’s responsibility to provide you with a privacy policy.

Usage

We ask that you use the learning analytics web app with respect. By using the web app, you agree not to use offensive language, engage in abusive behaviour, personal attacks, or any of the activities prohibited by our acceptable use policy and your institution’s acceptable use policy.

If you come across any occurrences of such prohibited behaviour, please contact us at customerservices@jisc.ac.uk or contact your institution. We reserve the right to take certain action (detailed below) if you do not comply with these terms and conditions.

Ownership of IP

Title to and ownership of all background IPR and the web app shall remain with Jisc. You will retain ownership of IPR in all content (eg images, text, comments, checkin history, performance metrics) uploaded to the web app. You grant to Jisc a worldwide, royalty free, irrevocable, non-exclusive licence (with the right to sublicence such rights) to use, copy, reproduce, distribute, publish, export, adapt, modify, edit and translate such content for our own business use and to enable our provision of the web app and learning analytics services to your institution, and do any act or thing in relation to the content which would otherwise be an infringement of the your IPR therein.

In these terms and conditions:

"IPR” means patents, registered designs, trademarks and service marks (whether registered or not), domain names, copyright, design right, trade secrets, know how and all similar property rights in inventions, computer programs and designs and all other intellectual property rights whatsoever and wherever subsisting; and

“Background IPR” means any and all IPR owned, controlled, created and/or developed by Jisc.

Any content that has not been created by you is copyright Jisc. The reproduction of our logos without permission is expressly forbidden. Permission should be sought from us at da.businessoperations@jisc.ac.uk.

Breach of these terms and conditions

Where we reasonably believe that an you are in breach of these terms and conditions (or any other terms referenced herein), we may take such action as we deem appropriate, including:

  • issuing a warning
  • removing resources from the web app at any time, without warning
  • closing or suspending your access at any time without notice
  • taking legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach and/or
  • taking any further legal action against you.

Liability

To the extent permitted by law, Jisc excludes all conditions, warranties, representations or other terms which may apply to your access to and use of the web app or any resources made available on it, whether express or implied. In particular, Jisc excludes all conditions, warranties, representations or other terms:

  • that any resource, information, guidance or services accessed via the web app will be of satisfactory quality, suitable or fit for purpose
  • in respect of the content of websites linked on the web app
  • that use of the web app or any resource will be compatible with all hardware and software
  • that the web app or any resource will be bug free, or that access to the web app or any resource will be uninterrupted
  • that the use of the web app or any resource will deliver a specific outcome for you
  • that defects in the web app will be corrected.

We will not be liable to you if for any reason the web app is unavailable at any time or for any period.

If we are liable to you in relation to your use of the web app for any cause whatever, and regardless of the form of the action then, unless the law says otherwise, we will only be responsible to you for loss or damage you suffer:

  • that is a foreseeable result of our breach of these Terms and conditions and
  • up to a maximum of £500.

Nothing in these terms and conditions excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

We are not responsible for maintaining any links users include in any content added to the web app. Any link is not intended to be, nor should be construed as, an endorsement of any kind by us.

Updates

Our services are constantly being developed and new features being added. We reserve the right to make changes, impose limits, and occasionally suspend or terminate your use of the web app for this purpose. We may also update our services, which might not work properly if you don’t install updates.

The learning analytics web app may allow your institution to send notifications to you via the web app. By signing into the web app using your institutional account, you are agreeing to receive these communications.

Changes

We may update these terms and conditions from time to time. Changes will have immediate effect from the date of posting. You should therefore review these terms and conditions regularly. Your continued use of the web app after changes have been made will be taken to indicate that you have accepted and are bound by the updated terms and conditions.

We reserve the right to revoke, withdraw or amend these terms and conditions without notice.
